In the name of culture?Following the end of natural law and the challenge of the alleged purely procedural rationality of law shaped neither by social nor by cultural influences, the question arises in numerous legal orders whether we need to think of "culture" as a new source of law and validity. It is quite evident that questions of criminal law - such as whether circumcision, which can be classified as a violation of bodily integrity, should be criminally punishable - differ from those of family law or constitutional law. But how does an opening towards cultural difference relate to the notion of the unity of the legal order and a universalistically conceived legal community? Around the globe, a fascinating debate is being carried out under quite different perspectives such as "normative pluralism", "cultural law", "parallel justice", etc. We wish to focus on how the reference to culture in this debate - be it affirmative or critical - can be understood as a challenge to the legal and cultural science disciplines.The Käte Hamburger Centre for Advanced Study in the Humanities "Law as Culture" offers a creative place of study for various disciplines in the cultural and legal sciences.
